Terms & Conditions — Trailer Hire

These Terms & Conditions (“Terms”) govern the hire of a Trailer and/or Equipment from Rent and Camp. By requesting or confirming a booking, paying a deposit, or collecting a trailer or equipment from Rent and Camp, you agree to be bound by these Terms, together with our Delivery Policy and Refund & Cancellation Policy, which form part of this agreement.

If you do not agree with any part of these Terms, please do not proceed with a booking.

1. Definitions and Interpretation

1.1. In these Terms, unless the context indicates otherwise:

1.1.1 “Company”, “we”, “us”, “our” means Rent and Camp, and its owners, employees, agents and representatives.

1.1.2 “Renter”, “you”, “your” means the person who books, pays for, collects or uses a Trailer or Equipment from the Company.

1.1.3 “Trailer” means any off-road camping trailer, caravan or towable unit hired from the Company, including the Bush Lapa range and any similar unit listed by the Company.

1.1.4 “Equipment” means any camping gear, appliances, fridges, accessories or add-ons hired together with, or separately from, a Trailer.

1.1.5 “Rental Fee” means the total hire charge for the Trailer and/or Equipment for the Rental Period, excluding the Breakage Deposit.

1.1.6 “Breakage Deposit” means the refundable security deposit described in clause 6.

1.1.7 “Rental Period” means the period from the agreed collection date and time to the agreed return date and time.

1.1.8 “Rental Agreement” means the specific booking confirmation and signed handover/rental documentation for a particular hire, which is read together with these Terms.

1.1.9 “GVM” means Gross Vehicle Mass and “tare” means the unladen mass of a vehicle.

1.2 Clause headings are for convenience only and do not affect interpretation. The singular includes the plural and vice versa, and any gender includes the others.

1.3 These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

2. Important Notice (please read)

2.1. These Terms contain provisions that:

2.1.1 may limit our risk or liability;

2.1.2 may create risk or liability for you;

2.1.3 require you to indemnify us in certain circumstances; and

2.1.4 serve as your acknowledgement of certain facts.

2.2 These provisions are drawn to your attention in line with the Consumer Protection Act 68 of 2008. If you do not understand any provision, please contact us for clarification before you book. Nothing in these Terms is intended to limit any right you have under the Consumer Protection Act that cannot lawfully be limited.

3. Bookings

3.1 A booking is only confirmed and secured once we have received the required deposit or full payment (see clause 5) and issued you a written booking confirmation.

3.2 Until a booking is confirmed, availability of any Trailer or Equipment is not guaranteed.

3.3 You warrant that you are at least 18 years old, hold full legal capacity to contract, and that all information you provide (including identity and licensing details) is true and accurate.

3.4 You must provide, on request and before collection, a clear copy of your South African ID or passport and a copy of your valid driver’s licence (see clauses 7 and 8). These are required for insurance purposes and, where applicable, for cross-border travel documentation. Cross-border documents must be 100% accurate to ensure trouble-free transit through border posts.

4. Vehicle (Towing) Requirements

4.1 It is your responsibility to ensure your towing vehicle is suitable, roadworthy and legally able to tow the Trailer. Your tow vehicle must have:

4.1.1 a manufacturer-approved towbar, correctly fitted and rated for the Trailer’s weight;

4.1.2 a standard 50 mm tow ball, secure and in good condition;

4.1.3 a working trailer electrical plug (7-pin or 12-pin) that correctly operates the Trailer’s brake lights, indicators and tail lights; and

4.1.4 a minimum tare of 1,500 kg.

4.2 If, on collection, your vehicle does not meet these requirements, we may refuse to release the Trailer. This will be treated as a Renter-initiated cancellation on the day of collection, and the Refund & Cancellation Policy (Part C) will apply. No separate refund is due for a vehicle that fails to meet these requirements.

5. Driver’s Licence Requirements

5.1 You are solely responsible for holding the correct, valid driver’s licence for the Trailer you book:

5.1.1 a Code EB licence is legally required (and required by our insurer) to tow a Trailer with a GVM above 750 kg; and

5.1.2 a Code B licence is sufficient for a Trailer with a GVM of 750 kg or less.

5.2 Any person who collects or tows the Trailer must hold the appropriate valid licence. If you nominate another driver, you remain responsible for verifying their licence.

5.3 If you cannot produce the required valid licence on collection, we are within our rights to refuse handover. This is treated as a Renter-initiated cancellation and the Refund & Cancellation Policy applies. We accept no liability for any fines, penalties or losses arising from towing by an unlicensed or incorrectly licensed person.

6. Breakage Deposit, Insurance & Excess

Breakage Deposit

6.1 A refundable Breakage Deposit is payable before collection, in addition to the Rental Fee. The default amounts are:

6.2–6.7 Breakage Deposit refunds & Insurance excess

6.2 The Breakage Deposit is refunded within 5 working days after the Trailer and/or Equipment is returned and inspected, provided the unit and all Equipment are returned in good working order, clean and undamaged.

6.3 The cost of any repairs, replacements, cleaning, missing items or shortfalls will be deducted from the Breakage Deposit, and any remaining balance refunded to you. Where the cost of damage exceeds the Breakage Deposit, you remain liable for the shortfall (see clause 9).

6.4 Our Trailers are fully insured. The following excess applies to any insured claim:

6.4.1 R 5,000.00 for incidents within South Africa and R 10,000.00 outside South African borders (i.e. in approved neighbouring countries). Cross-border cover is limited to countries approved by our insurer — Botswana, Namibia, Lesotho.

6.5 No claim of a value lower than the applicable excess will be processed. In the event of a claim, the applicable excess will be withheld from your Breakage Deposit, and where the excess or claim shortfall exceeds the Breakage Deposit, you remain liable for the balance.

6.6 All damage to the Trailer and Equipment, and the associated insurance claims, are subject to the terms set out in clause 6 of the Rental Agreement and in clause 9 below.

6.7 Insurance does not cover, and you remain fully liable for, loss or damage caused by: negligence, reckless or unlawful driving, driving under the influence of alcohol or drugs, use by an unauthorised or unlicensed driver, off-road use where the unit is not approved for it, tyres, personal belongings, and mechanical or electrical failure not caused by an insured event.

7. Collection, Fitment & Handover

7.1 Collection of the Trailer and Equipment, and all fitment, take place at our premises.

7.2 At collection, we and you will complete a handover inspection documenting the condition of the Trailer and Equipment (with photos and notes). At return, a matching inspection is completed and compared against the collection inspection. You should raise any pre-existing damage or concerns at collection.

7.3 You are responsible for correctly connecting, securing and testing the Trailer to your vehicle before departure, including confirming that lights, brakes and the coupling are working.

8. Use of the Trailer and Equipment

8.1 During the Rental Period you must:

8.1.1 use the Trailer and Equipment only for their intended purpose and in a safe, lawful and responsible manner;

8.1.2 comply with all traffic laws, road regulations and, where relevant, cross-border requirements;

8.1.3 not exceed the Trailer’s rated load or take it off-road unless the unit is approved for off-road use;

8.1.4 not permit any unauthorised or unlicensed person to tow or operate the Trailer;

8.1.5 not smoke inside the Trailer and not permit any unlawful activity in or around it; and

8.1.6 take reasonable care to secure the Trailer and Equipment against theft, loss and damage.

8.2 Charging and power: Most South African campsites offer 220V electricity, allowing the Trailer to be plugged in to keep the batteries charged. For bush or off-grid camping, batteries can be recharged via the roof-mounted solar panel (ensure it is switched on at the DB board inside the unit) or through your vehicle using a battery cable with a Brad Harrison / Anderson plug. The Brad Harrison / Anderson plug must be installed by you (the client). See Annexure A for further use notes.

8.3 Kitchen essentials: The Trailer is supplied without cutlery or kitchen essentials, so that you can bring your own. Please pack your own cutlery, plates, bowls, mugs, cooking utensils, dishcloths, washing-up liquid, and any food or spices.

9. Damage, Loss and Liability

9.1 You are responsible for the condition of the Trailer and Equipment for the full Rental Period, including the interior and exterior, and for returning it in the same condition as at collection (fair wear and tear excepted).

9.2 You are liable for any and all damage, loss or theft occurring during the Rental Period, including any damage that cannot be shown to have existed before the Rental Period, as well as any traffic fines or tyre damage incurred during the Rental Period.

9.3 You must report any damage, loss, breakdown or accident to us as soon as reasonably possible and provide clear, dated photographs and any information we or our insurer reasonably require.

9.4 Where insurance cover is insufficient, declined, or does not fully cover the loss, you remain liable for the full cost of repair or replacement needed to restore the Trailer and Equipment to their pre-rental condition, together with the applicable excess.

9.5 Cross-border breakdowns: In the event of a breakdown, accident or damage occurring outside South Africa, you are responsible for returning the affected Trailer to the nearest South African border post. Towing, recovery or insurance processes will only be initiated once the unit is back within South African territory. We are not liable for the cost or logistics of cross-border recovery.

10. Assumption of Risk

10.1 Camping, towing and off-road travel involve inherent risks, including driving and towing risks, mechanical failure, accidents, adverse weather, road and terrain conditions, and risks associated with outdoor activity.

10.2 By booking and using the Trailer and Equipment, you acknowledge and voluntarily accept these risks. To the fullest extent permitted by law (and subject to clause 11.3), we are not liable for any injury, death, loss or damage arising from these risks.

11. Limitation of Liability and Indemnity

11.1 To the maximum extent permitted by South African law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of enjoyment, or the cost of alternative arrangements, arising from your booking or use of the Trailer or Equipment.

11.2 You indemnify and hold us harmless against any claims, losses, damages, fines, costs or expenses (including reasonable legal costs) arising from your use of the Trailer or Equipment, your breach of these Terms, or any act or omission by you or any person you permit to use the Trailer, except to the extent caused by our gross negligence or wilful misconduct.

11.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, for gross negligence, or for any liability that may not lawfully be excluded under South African law (including under the Consumer Protection Act).

12. Force Majeure

12.1 We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, fire, flood, storms, epidemics or pandemics, war, civil unrest, strikes, government action or restrictions, border closures, failure of utilities or third-party service providers, and similar events.

13. Protection of Personal Information (POPIA)

13.1 We are committed to complying with the Protection of Personal Information Act 4 of 2013 (POPIA). We collect and process personal information (such as your name, contact details, ID/passport, driver’s licence and payment information) only for purposes of managing your booking, verifying identity, meeting insurance and cross-border requirements, and complying with the law.

13.2 Your documents are stored securely, used only for the purposes above, and are not shared with third parties except where necessary to provide the service (for example, with our insurer) or as required by law.

13.3 You have the right to access, correct or request deletion of your personal information, subject to our legal retention obligations. Requests may be sent to kampkole@gmail.com.

14. Dispute Resolution

14.1 Any dispute regarding an insurance claim, the Breakage Deposit, or a refund must be raised with us in writing within 7 (seven) days of the end of the Rental Period.

14.2 The parties will first attempt to resolve any dispute amicably. Failing resolution, the dispute may be referred to arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA), conducted in English in Paarl. This clause does not prevent either party from approaching a court of competent jurisdiction where the law allows, including under the Consumer Protection Act.

15. General

15.1 Non-discrimination: We provide our service without discrimination on the basis of race, gender, religion, nationality, disability, sexual orientation or marital status.

15.2 Amendments: We may amend these Terms from time to time. The version in force at the time of your booking applies to that booking. The latest version will be published with its “last updated” date.

15.3 Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.

15.4 Whole agreement: These Terms, together with the Delivery Policy, the Refund & Cancellation Policy, and your Rental Agreement, constitute the whole agreement between you and us regarding your hire.

Annexure A — Equipment & Use Notes

These notes are provided to help you get the most out of your hire. They form part of your responsibilities under clause 8 of these Terms.

Keeping the batteries charged and the fridge cold — Most South African campsites offer 220V electricity: plug the Trailer in to keep the batteries charged while you camp. For bush / off-grid camping, recharge the batteries via the roof-mounted solar panel (make sure it is switched on at the DB board inside the unit); or via your tow vehicle, using a battery cable with a Brad Harrison / Anderson plug (this plug must be installed by you).

Kitchen essentials — bring your own. The Trailer does not include cutlery or kitchen essentials, so everything you use is exactly to your standard. Please pack: cutlery (knives, forks, spoons); plates, bowls and mugs; cooking utensils; dishcloths, washing-up liquid, and any food or spices.

Why we need a copy of your ID and driver’s licence — In the event of an insurance claim, proper identification is required. Cross-border documentation must be 100% accurate for trouble-free border transit. A Code EB licence is required (legally and by our insurer) for trailers with a GVM above 750 kg; a Code B licence is sufficient for trailers with a GVM of 750 kg or less.
